Terms of Use
Draft — not yet reviewed by counsel.
Last updated: 7 October 2026 · Version 2026-10-05
These are the terms between you and Bobao LLC, a California limited liability company. Plain English on purpose: a term you cannot understand is not one you agreed to.
1 · What Bobao is, and what it is not
Bobao holds stamp cards on your phone for shops that have joined.
Bobao is the messenger. Bobao carries a shop's card, reward, notes and listing to you, and carries your check-ins, requests and reviews to the shop. It is not a party to the deal between you and a shop, and it does not provide, guarantee or substitute any shop's reward or service.
What Bobao does itself it answers for: how it handles your personal data under the privacy policy, Bobao Points, levels and companions, Bobao Supporter billing, and the security of your account.
Bobao is not the shop. We are not the merchant, we do not sell you anything the shop sells, and we do not take your money on their behalf. The shop sets its own card, writes its own reward, and hands that reward over at its own counter.
We do not guarantee any reward. We cannot make a shop honor a card, keep a price, stay open, or stay in business. If a shop refuses a reward you have earned, tell us — we will take it up with them and we can remove them from Bobao — but the obligation is theirs, not ours.
Rewards have no cash value and can only be claimed at the shop that issued them.
Bobao Points are a record of activity, not currency. They are never spent, never exchanged, never transferred, and cannot be bought. They set your level, and your level introduces companions. That is all they do.
2 · Points, stamps and rewards are not money
- No cash value. Points, stamps, levels, companions and rewards have no cash value. They are not your property, and they cannot be sold, transferred, traded, or cashed out — not to another person, and not back to Bobao or to a shop.
- Not stored value. Bobao is not stored value, a gift card, a prepaid card, or a wallet for money. You never load money into Bobao, nothing in it holds a balance of money, and nothing in it can be turned into money.
- Expiry is the shop's to set. Each shop may set a card expiry (an unfinished card closes after it has gone this long without a stamp) and a reward expiry (a full card has to be claimed within this long of its last stamp). Both default to never. When a shop sets one, the card shows you the exact date and the days left. When an unfinished card closes, the stamps and points you earned stay on your account.
- A change to a shop's card never reaches a card you already hold. A shop can change its card, and the change applies to cards whose first stamp lands after it. Every card already open keeps the length, reward and dates it opened with until it is claimed. An end date on a shop's card stops new cards only; a card already open carries on.
- How points, levels and companions work can change. We may change how points are earned, how levels are reached, and which companions a level introduces. A change applies from the day it takes effect: it never takes back points you have already earned, a level you have reached, or a companion you have already met.
3 · Rewards depend on the shop
Rewards are provided and fulfilled by the independent shop that issued the card, not by Bobao. Claiming one depends on that shop being open and still partnered with Bobao.
- A shop that leaves gives notice. A shop leaving Bobao has to give at least 30 days' notice, so that anyone holding a full card has time to claim it. We will tell card holders when we learn a shop is leaving, or has left.
- If a shop closes, leaves Bobao, or stops honoring rewards, Bobao does not reimburse you, substitute another reward, or pay out the card's value in cash. The points you earned there stay on your account.
- What a shop sets is the shop's to stand by — its card and reward terms, quantities, limits, expiries, schedules, notes, hours and listing details. Bobao does not honor or substitute any of it.
4 · Who can use it
You must be 13 or older. You confirm this when you create an account, and we record the confirmation.
One account per person. Do not share it, and do not sign in as somebody else.
You stand by what you set. You are responsible for what you set, submit or choose in Bobao — your account and sign-in details, your settings and privacy choices, reviews, shop requests, and removing a card or deleting your account — and Bobao is not responsible for the results of those choices. This takes away none of your rights under privacy law, the 14-day hold on a deletion, or the promise that a shop's change never reaches a card you already hold.
5 · Stamps have to be earned in person
A stamp requires verification at the counter: a staff PIN, the shop's counter code scanned by you or your code typed in by staff, your phone number typed in by staff if you turned on check-in by phone number, or your location within about twenty meters at a shop that accepts it. One stamp every 15 minutes per shop.
Do not try to get a stamp you did not earn. Spoofing your location, sharing a code, or arranging a stamp for a visit that did not happen is a breach of these terms. It is also the reason shops are willing to put a real reward at the end of a card, so we treat it seriously: we will reverse the stamps and we may close the account.
A reversal is always a recorded correction — never a silent edit. A companion you have already met is never taken back.
6 · What you post
Reviews, photos and shop requests are yours, and you are responsible for them. By posting, you give us permission to show them in Bobao and to let the shop see them.
Do not post anything false, anything that is not yours to post, anything abusive, or anything identifying another customer. A person in a photo can ask for it to come down, and we will take it down.
We can remove anything that breaks these rules, and we will say why. A shop can decline a photo on its own listing; your words go up either way.
Reports go to a person at Bobao. A shop is never told a report exists and never learns who filed one.
Copyright. If you believe something in Bobao infringes your copyright, send a notice to our designated agent at hello@getbobao.com with the subject “Copyright notice”. It needs: your physical or electronic signature; the work you say is infringed; what in Bobao infringes it and where it is (a link or the shop and review); your name, address, phone and email; a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for them. We take the material down promptly and tell the person who posted it.
If your post was taken down and you believe that was a mistake, you can send a counter-notice to the same address: your signature; what was removed and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your name, address and phone, with consent to the jurisdiction of the federal court for your district (or, outside the US, any district where Bobao may be found) and to accept service from the person who sent the notice. We pass it to them, and put the material back in 10 to 14 business days unless they tell us they have filed a court action. Accounts that repeatedly post infringing material are closed.
7 · Bobao Supporter
Bobao Supporter is US $40 a year, yearly only. There is no monthly plan.
Prices are in US dollars; your bank may convert. Prices do not include taxes that may apply where you live.
- It renews each year until you cancel. You will be charged US $40 on each renewal date, and we email you 30 days before each renewal.
- Founding Supporter. During the first season only, for a limited number of accounts (the app shows how many places are left), US $30 for your first year; it then renews at US $40 a year, and we email you 30 days before the first year ends.
- Cancel at any time from Settings → Bobao Supporter, which opens Stripe's billing page. You keep Bobao Supporter until the end of the period you have paid for.
- Your price is locked while you stay subscribed. New subscribers pay US $50 a year from Season 2; you would keep US $40. The lock survives only while you are subscribed — if you cancel and come back, you pay the price current then.
- Where it goes. Support goes to Bobao, not to any shop. It is not a charitable gift and is not tax-deductible.
- What it is: companions a week early and wallet colors. It adds no points.
- What it never does: buy a stamp, a reward, a level or a companion. It never multiplies points. It never changes what a shop sees about you.
- If your membership lapses (a renewal payment fails) or you cancel, nothing you earned is lost. Points, levels, companions and cards are untouched.
All sales are final: we do not refund a period already started, except where the law requires a refund. We may change this policy or make an exception at our discretion. This does not affect rights you have under your province’s or state’s consumer protection law.
8 · Ending it
You can remove one shop's card from your wallet, from that card. Your cards at that shop leave your wallet, a reward that was ready goes with them, and the points you earned stay. The shop keeps its own record of the stamps it gave.
You can delete your account at any time from Settings. Everything is held for 14 days in case you change your mind, then deleted. Reviews you posted stay up as written by a former member, and stamps a shop already recorded stay on the shop's side — those are that business's own records.
We can close an account for breaking these terms. Where we do, we will say why, and you can write back. If we close an account for fraud or abuse — stamps for visits that did not happen, a spoofed location, shared or misused codes — the points, levels, cards and unclaimed rewards on it end with it, and are not paid out or moved to another account.
9 · Things we have to say
Bobao is provided as it is. We work hard to keep it accurate and available, and we do not promise it will never be wrong or never be down.
To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the greater of what you have paid us in the past twelve months or US $100. Some states do not allow these exclusions or limits, so some of them may not apply to you.
Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Nothing here affects your statutory rights as a consumer.
10 · Changes
If we change these terms in a way that matters, we will tell you in the app. The version you agreed to is recorded on your account with the date.
11 · Disputes
Talk to us first. If something goes wrong, write to hello@getbobao.com and tell us what happened and what you want. Most things are settled that way. Neither of us starts a formal claim until 30 days after the other has been told about it in writing.
Governing law. These terms are governed by the laws of California and the United States, without regard to conflict-of-laws rules. The arbitration agreement below is governed by the Federal Arbitration Act.
Arbitration, one person at a time. If talking does not settle it, a dispute between you and Bobao about Bobao is decided by binding arbitration with the American Arbitration Association under its rules for individual claims, not in court. The hearing is by video or phone, or near where you live. For a claim under US $10,000 we pay the filing and arbitrator fees beyond what you would pay to start a case in court. The arbitrator can give you the same relief, for you, that a court could.
Small claims court is always open. Either of us can take a claim that qualifies to small claims court instead.
No class actions. Claims are brought individually, never as a class, collective or representative action. This does not stop you asking a court for public injunctive relief where California law says that right cannot be waived. If this paragraph is found unenforceable for a claim, that claim goes to court, not arbitration.
No jury. Where a claim goes to court instead, we both give up a jury trial, to the extent the law allows.
Many claims at once. If 25 or more similar claims are filed against Bobao by or with the help of the same lawyers or group, they are handled in batches under the American Arbitration Association's mass-arbitration rules, and the time limits pause while that happens.
One year to bring a claim. Where the law allows a shorter limit, a claim about Bobao has to be started within one year of when it arose.
You can opt out. Email hello@getbobao.com with the subject "Arbitration opt-out" within 30 days of first accepting these terms. Opting out changes nothing else.
Courts. Anything not arbitrated is heard in the state courts in San Francisco County, California, or the federal court for the Northern District of California, and we both agree to them.
If you live in Canada, the arbitration and class-action paragraphs do not apply to you, and nothing here takes away the protection of the laws and courts of your province.
If one part fails, the rest of these terms still stands.
12 · Shops, safety and the rest
Who counts as a shop. A shop is any independent business listed on Bobao, whatever it sells — drinks, treats, food, goods or services, today or in any category added later. Every promise these terms make about shops covers all of them.
Bobao makes, sells, prepares and serves nothing. Each shop alone is responsible for what it sells: its products and their quality, ingredients and allergens, food safety, licenses, prices and taxes, any age limits on what it sells, and its premises. The value of a reward is set by the shop and fulfilled by the shop. Bobao does not run cards for alcohol, tobacco or vaping products, cannabis, gambling or other age-restricted goods without separate terms.
Shop information may be wrong. Hours, menus, prices, locations and other listing details come from shops and from public map data such as OpenStreetMap, and can be out of date. Check with the shop before you rely on them. Tell us about a mistake and we will fix or remove it.
Food, allergies and health. Bobao does not know what is in anything a shop sells. If you have an allergy, a dietary need or a health condition, ask the shop. Nothing in Bobao is health advice.
Location and safety. Location is used only when you allow it. Do not use Bobao while driving or anywhere it is unsafe to look at a phone, and follow the law and the shop's rules where you are.
Using Bobao fairly. Do not break the law with Bobao, interfere with it, scrape it, reverse engineer it, get around its limits, or pretend to be someone else. We may suspend or close an account that does, as section 8 says.
Your content license. When you post a review, photo or request, you give Bobao a worldwide, royalty-free, non-exclusive license to host, show, adapt for display and share it within Bobao and with the shop, for as long as it stays up and as section 8 describes after you leave. You confirm you have the right to post it.
If you cause a claim. If someone makes a claim against Bobao because of what you posted or a breach of these terms by you, you will cover Bobao's reasonable losses and costs from it, to the extent the law allows.
Changes to these terms. We tell you in the app before a change that matters takes effect. If you keep using Bobao after it does, the new terms apply; if you do not agree, you can delete your account. A change never applies to a dispute already started.
Electronic messages. You agree that we may give you notices, receipts and these terms by email and in the app, and that they count as being in writing.
Where you live. Bobao and its features, points and rewards may vary by location, and Bobao is not offered where the law forbids it. Where the law of the place you live gives you protection these terms cannot take away, that protection applies.
Apps from Apple and Google. If you got Bobao from the App Store or Google Play, these terms are between you and Bobao LLC, not Apple or Google. They are not responsible for Bobao or its support, and they may enforce these terms against you as third-party beneficiaries. The store's own terms of use also apply.
The rest. These terms, with the privacy policy and the Notice of Financial Incentive, are the whole agreement between us about Bobao. If we do not enforce something, we have not given it up. We may transfer these terms to a company that takes over Bobao; you may not transfer them. Neither of us is responsible for a delay or failure caused by events outside reasonable control, such as outages, disasters or the actions of governments.
