Partner Terms

Draft — not yet reviewed by counsel.

Last updated: 6 October 2026 · Version 2026-10-05

For businesses running a stamp card on Bobao. Agreed at checkout, alongside the general terms.

Bobao is the messenger. Bobao carries your card, reward, note and listing to your customers, and carries their check-ins, requests and reviews to you. It is not a party to the deal between you and a customer, and it does not provide, guarantee or substitute your reward or your service.

What Bobao does itself it answers for: how it handles personal data (as the independent controller in section 5), Bobao Points, levels and companions, Bobao Partner Plus billing, and account security.

1 · What you are agreeing to

You run the card. Bobao holds it.

You stand by what you set. You alone set, and are responsible for honoring, everything you set or publish through Bobao: your card and reward terms, quantities and limits (for example, "while supplies last"), expiries, schedules, your note, your hours and your listing details. Bobao is not responsible for honoring any of it and does not substitute for it. Whatever limits you set, you honor every card a customer has already earned.

We can suspend or remove a listing that breaks these terms, and we will tell you why.

2 · What it costs

Nothing to join and nothing to run a card. The Free plan is a $0 checkout through Stripe — the charge is zero, and it exists so receipts, notices and ownership verification have a home.

Bobao Partner Plus is priced per shop: US $440 a year (or US $40 a month) for your first shop, US $340 a year (US $30 a month) for each additional shop, and US $240 a year (US $20 a month) from the sixth. Shops you own share one subscription and renew together. A shop added mid-period is charged only for the rest of the period; a shop you take off keeps Partner Plus for the period already paid, with no refund, and is not billed at the next renewal. Prices are in US dollars; your bank may convert. Prices do not include taxes that may apply where you live. It buys deeper analytics and one labeled sponsored row. It never buys the card, and it never affects your customers' access to their cards: partnering is free, so canceling Partner Plus changes nothing about the cards your customers hold.

A free trial, and Founding Partner pricing. Once your shop has 30 or more open cards, Bobao may offer you 60 days of Partner Plus free, once per shop and never at signup. Starting the trial starts a subscription: when the 60 days end, it becomes a paid Partner Plus subscription at US $40 a month or US $440 a year (the interval you chose when you started the trial), charged to the payment method on file and renewing automatically until you cancel. To pay nothing, cancel before the trial ends from Billing and invoices on your plan page; we email you 14 days before it ends. A limited number of the first shops to subscribe to Bobao Partner Plus pay 25% less for their first year — US $30 a month or US $330 a year — and the normal price after it; the plan page shows the date it ends and we email you 30 days before. A founding place and the trial do not stack: a founding place comes first, the trial only when none is left.

A Sponsored boost is US $50 for 7 days, US $100 for 14 or US $150 for 30, 10% off on Partner Plus (US $45, US $90 or US $135), paid once through Stripe — not a subscription, and open to every shop on any plan. It is paid placement: it makes your shop eligible for the one labeled "Sponsored" row for that period, under the same rules as Partner Plus's row — second in the list, within a mile, never when someone searched for a specific shop, never above a card with a reward ready, never spoken by a companion, only in the hours you choose. It does not guarantee that the row is shown to anyone: at most two shops within a mile can be boosted at once, eligible shops take turns, and people can hide sponsored rows for 30 days. There is no bidding and no per-tap charge.

All sales are final. A boost, Partner Plus and any other charge are not refunded once paid — including when you close the shop yourself, when people hide sponsored rows, or when Bobao hides or closes your listing — except where the law requires a refund. Bobao may change this policy or make an exception at its discretion; nothing here obliges it to.

There is no per-stamp fee.

3 · How we know the shop is yours

Through Stripe, at that $0 checkout: you link the business bank account and Stripe checks the account holder's name against the business.

We don’t ask for identity documents today and nobody at Bobao reviews paperwork. If you pay by card instead, your listing says "owner check pending" until a bank account is linked.

You confirm you are authorized to act for the business.

4 · Your content

Your shop’s name and logo, your card design, your reward text, your note and the photos you add are yours. You give Bobao a license to store, display and adapt them (for example, to fit a screen) in Bobao, for as long as your listing is on Bobao and for the cards your customers still hold after it. You confirm you have the right to give that license, and that nothing you add is false or unlawful. That license includes showing your shop’s name and logo on your stamp cards, on your listing and anywhere in Bobao that points people to your shop. Your name and logo stay your trademarks; using them this way gives Bobao no other right to them, and it ends when the license above ends.

5 · Customer data: whose it is, and what you see

Bobao is the independent controller of customer data. Customers create their accounts with Bobao, not with you, and Bobao decides what is collected about them and why, under its own privacy policy. Bobao does not process customer data on your behalf or on your instructions, so there is no data processing agreement between us: you are not our controller, and we are not your processor.

You see: a first name and one initial, the count on their card with you, the time of a check-in, and how it was verified. Reviews carry the same, plus a verified-visit count.

You never see: an email address, other cards, a level, companions, location, or anything a customer has told us about themselves.

Bobao Partner Plus analytics are aggregates — counts by day, counts of regulars, cards finished, first visits. Never a named list, and never an individual's history. Exports contain the same aggregates. Beyond the first name and initial at your own counter, you receive only aggregate insights — never a customer's identity — and we never sell your customer list to anybody else.

You agree that you will not:

This is the promise we make to every customer, and it is the one term here we will end a partnership over.

You cannot message customers except through your note (section 8). There is no other channel from you to a customer on Bobao.

Your own data, and your staff's. You and your staff are Bobao users too, and the privacy policy covers you. That includes the advertising, analytics and measurement tools it describes, which may run in the shop-owner tools — the counter, the dashboard and the card builder — on the staff and partner pages, and in our emails, with the same opt-out and cookie choices as everyone else. None of this changes the promise above: those tools never give anyone your customers' names or visits.

6 · Stamps, and staff

Every stamp needs one of the methods you accept: a staff PIN, your counter code scanned by the customer, the customer's code typed in by your staff, the customer's phone number typed in by your staff (for a customer who turned on check-in by phone number), or the customer's location within about twenty meters (only if you turn location check-in on; it is off unless you do).

Staff PINs are yours to issue and to revoke. A PIN cannot be read back out by anyone, including us. Removing a staff member stops their PIN immediately. Keep the list current — a stamp confirmed with a PIN is attributed to whoever holds it.

Do not stamp a card for a visit that did not happen. We reverse stamps we find, with a recorded correction, and repeated cases end the partnership.

Staff authentication credentials and system abuse

7 · The rewards your customers earn

You must honor every reward a customer has earned under your card, on the terms that card opened with, at your counter. You will indemnify Bobao against claims arising from your failing to honor one.

8 · Your listing and your note

Keep your details accurate. You may post one note on your listing — a line about hours, stock, a seasonal item or a closure.

On the Free plan, prices and offers are not allowed in a note. On Partner Plus, a note may also carry new drinks and specials. No note may change a card or a reward.

You are responsible for what your note says: nothing false, nothing unlawful, and no offer unless you are on Partner Plus. We may remove a note that breaks these rules. The note is the only way to reach your customers through Bobao. On the Free plan it reaches only those who asked for it; on Partner Plus it may reach everyone holding an open card at your shop, at most once every 7 days, never in quiet hours, and every one carries a way to stop hearing from you.

9 · Changing the card

A change applies to cards whose first stamp lands after you publish it. Every card already out keeps the length, reward and dates it opened with, until it is claimed. Nobody is moved mid-card.

10 · Leaving

You can release the shop with at least 30 days' notice, so that anyone holding a full card has time to claim it. Until the release date, stamps and rewards work as normal, and you honor every full card presented before it.

You keep your own stamp records. Customer accounts stay with the customers.

If you are on Partner Plus, canceling is in Stripe's billing page and takes effect at the end of the period you have paid for. Only the shop's owner can open that page; staff cannot.

11 · Things we have to say

Bobao is provided as it is. We do not guarantee any level of traffic, visits, or new customers, and nothing in our marketing is a promise of business.

To the extent the law allows, our total liability to you is limited to the fees you have paid us in the past twelve months.

Each of us is an independent business. This is not a partnership, franchise, agency or employment relationship in the legal sense, whatever the word "partner" suggests.

12 · Disputes

Talk to us first. Write to hello@getbobao.com. Neither of us starts a formal claim until 30 days after the other has been told about it in writing.

Governing law and courts. This agreement is governed by the laws of California, without regard to conflict-of-laws rules. Disputes are heard in the state courts in San Francisco County, California, or the federal court for the Northern District of California, and we both agree to them. Either of us can use small claims court for a claim that qualifies.

If the law where your shop is protects you as an individual buyer, including in a Canadian province, nothing here takes away the protection of those laws or courts.

If one part fails, the rest of this agreement still stands.

13 · Promises both of us make

What counts as a shop. These terms cover any independent business listed on Bobao, whatever it sells — drinks, treats, food, goods or services, today or in any category added later.

What you promise. You have the authority to accept these terms for the business. The business holds the licenses and permits it needs, follows food safety and other laws for what it sells, and keeps its listing accurate. You alone are responsible for your products, their ingredients and allergens, your prices and taxes, any age limits on what you sell, your staff and your premises. Bobao does not run cards for alcohol, tobacco or vaping products, cannabis, gambling or other age-restricted goods without separate terms.

Bobao makes, sells, prepares and serves nothing. It never takes part in a sale at your counter.

Your indemnity. You will cover Bobao's reasonable losses and costs from a claim arising from your products, your premises (including an injury there), your staff, a reward you did not honor, your listing or note, or your breach of these terms.

Limits for both of us. To the extent the law allows, neither of us is liable to the other for indirect or consequential loss or lost profits, and each side's total liability is limited to the fees you paid Bobao in the past twelve months. These limits do not apply to your indemnity, to fees owed, or to anything that cannot lawfully be limited.

Confidential information. Each of us keeps the other's non-public business information private and uses it only for Bobao. Customer data is handled as section 5 says.

Delisting. We may hide or remove a listing that breaks these terms, puts people at risk, or that we cannot verify, and we will tell you why.

The rest. These terms are the whole agreement between us about Bobao. We tell you by email before a change that matters takes effect; if you keep using Bobao after it does, the new terms apply. If we do not enforce something, we have not given it up. We may transfer these terms to a company that takes over Bobao; you may transfer them only with our written agreement. Neither of us is responsible for a delay or failure caused by events outside reasonable control. Features and fees may vary by location, and the mandatory law where your shop is applies where it must.
